Government appeals in transgender Garden City funeral director case - Crain's Detroit Business

Monday, October 17, 2016

Religious Freedom Restoration Act.The commission sued the the family-owned business in 2014 after it informed Aimee Stephens that what she was "proposing" was unacceptable and fired her from its Garden City location. Stephens, formerly Anthony Stephens, had been an employee since 2007.Cox in a 56-page ruling stated EEOC had failed to challenge the funeral home's gender-specific dress code, which requires male employees to wear a pant suit and female employees to wear a skirt suit. Title VII, an amendment in the Civil Rights Act of 1964, prohibits discrimination based on sex, race, age, religion or national origin, but does not include gender identity. This Detroit case is the second of its kind filed by the EEOC nationally, both for transgender employees who had presented as women.
